Our employer is eating a lot of money and we decided to start our own consultancy .

as far as i know...you should have a green card to start your own company in US...

working visa, bussiness visa veru veru kada...
if he had bussiness visa i guess he will face some issue for working in other companies...
generally companies only prefer, opt, h1b, greencard...
