Nenu currently on OPT and na OPT July 2013 varaku vundhi but nen H1 ee year ye apply cheseddam anukuntunna....

ma employer consular processing apply cheddam antunnaru, he said that we will get an approval but H1 doesnt start on Oct 1st and we can delay it till my OPT expires..... OPT meda india velli ravataniki advantage vuntadi and 9 months opt(taxes or what ever) kalisi vastai antunnaru....

Suggestions needed shall i go ahead with that ? Advantages/Disadvantages please...

If nenu OPT meda vundi and H1 consular process lo approval vachi india velli and stamping ki velli reject ithe and if my OPT is still valid shall i come back into the country ?

ee yr H1 file chaesi ,neeku approval vachindhi antae aa H1 status automatic ga OCt 1st nunchi start avuthundhi..u really cant stop the transfer of status from F1 to H1 if approved once.And once if H1 is approved and if else u go out of country u have to get the stamping and re-enter USA.No doubt on dat.

Looks like your employer is dumb. Consular processing doesn't apply for candidates on OPT or etc. It applies for people out of US or for people who directly want to convert to H1 from F1 or H4 or B1 or L1.

If you get your H1 approved this year lets say, you will have a max of 6 months i.e until Apr to be on OPT your H1 automatically gets kicked in by Apr 1st 2013. Once you get the approval if your [b]VISA[/b] not OPT is valid, you can still go to india and come back with out any stamping or etc.

Also bossu even if you file your H1-B on July in 2013, you will be in status till OCT 1st 2013 because for OPTs Cap Gap extension is automatically applied.

no, you have an option to select when you want your H1 to start. Again this is for OPTs. The date you could select max is 6 months from OCT 1st. Lets say your OPT is valid till Feb 13th. You want to save your taxes or what ever, you can keep your H1-B start date as Feb 13th since it is in the 6 month period. Even if you apply for H1-B on Apr 1st 2012, if your OPT is valid, you can opt your H1-B start date.

July 2013 varaku OPT undi kabatti..he can file your H1B in Jan'13 if quota is open and can put the start date in June'13. It works this way...after Oct 1st, apply cheste...u can mention start dates and those dates should fall within 6mo. or Apr'13 ki file chesthe...u can apply for capgap i20 and work until Oct 1st.
