NEED HELP TO TRANSFER MY H1 VISA

Hi To All

I am having H1 visa.I am in India.My consultant saying you come to USA after 6 months.Now i want to transfer my visa to another company.

The company told me you go for vacation and come back after 2 months.I trusted this company,I came to india.Its almost 4 months there is no response from this company.

Can anybody help me to transfer my visa.I wanted to come there in March.

I appreciate your help.

naaku telisi nuvvu ippudu H1Btransfer apply chesukovadam risk.
h1 transfer apply chesetappudu u need to give 2 of ur most recent pay stubs.
nuvvu india lo 4 months nunchi unna antunavu kada. so it may be a problem.
i may be wrong.

Hi,
I am not sure what to say. Even if you change your company there is no sure that you will be allowed into USA at airport.
you have lot of problems in doing that,
1. your transfer should be approved
2. you should be allowed into USA
3. you should have a job to show immigration an offer letter

My problem is

I do not have latest pay slips.

But If i have an appointment letter. Is it ok.Then what about this stories of sending back to India at the point of entry.Is It Right.

Please help me what are the documents i have to carry to come there

only appointment letter or any other documents.

Its practically tough to transfer visa when you are in India and that too with all the new H1 rules. Its like poking the nose of USICS and getting yourself into trouble.

My advice is that, try to be on safe terms with your current employer, come to US (even if it is bit late) and transfer visa once your position is safe. Present situation lo H1 transfer is very risky. I havent heard any success stories about H1 transfer off late.

one visa is stamped and other one i did not go for stamping.

My questions is that old company visa is valid or not.I want to know that.The old company is asking me to come there.they said they will provide my appointment letter.But they do not know that i transferred my visa.

My new company has been closed.I do not know what to do.

please give me advice

you can come to US if you have a valid visa irrespective of the company

If your petition is valid with the old employer than you can come with the old visa that is not a problem.
Transfer of H1 is a misnomer, it is actually like you have 2 visas both valid only catch is you cannot work on both h1 at the same time.

If your stamping is done on your old visa you can come without any issues.

This is the worst time to transfer H1B, there a new memo released by USCIS on Jan 13 which defines employer-employee relationship, which has many complicated clauses which might change the way consulting works in future, i am not sure about people who already have enough H1B validity, but from now it seems USCIS need clear and complete information about where the consultant is going to perform services, which itself is tough to answer by many consuting companies and hence rejection is imminent in those cases, earlier these kind of cases were dealt with RFE's etc

it is also clearly mentioned that 221(g) is clear refusal from now rather than administrative check

my suggestion is to deal smoothly with your current employer and try to negotiate with him

I have at least two friends whose H1B transfer has been rejected, the practice of changing compnanies is being discouraged now, unless and untill you get full time and change to some credible employer, don't think of transfer

my personal sugegstion is to keep looking for job in india as well as the current situations is bad here at port of entry as well, atleast it keeps your resume with activity
