I recently decided to apply for Canadian PR from US under federal skilled category which opens in 2013. I even paid lawyer David Cohen lawyer fee to get started and they started my documentation for applying in Jan 2013 as soon as the quota opens on Jan 1st. Today i was sent a form to clarify and confirm i have no medical conditions. We were talking all through the month on different aspects but he never talked about medical conditions. Now , today he told me that Medical is Free in canada and that PR will be denied if the candidate who applies has diseases which are transferable like HIV + and also diseases which are burden to Canadian Govt . Now , my problem is i was diagnosed of diabetes 3 months before. It's not so high and now it is in control. When i checked forums i saw advices saying

1.Diabetes in future might cause to kidney failure and might be a silent killer and hence would be burden to canadian health care.
2. Some people said canada health care doesn't provide medicines and do only health check ups so daibetic patient is not a burden to CA govt as he pay for his medicines.
3. Some said 1 in 4 has diabetes and that it is not a big deal.

I am so confused now as i already paid the lawyer fee and didn't even get a thought about medical conditions.

I heard Medical Exam is mandatory to get PR so what tests do we have to go through? If i hide the fact that i am just in border line or just diagnosed 3 motnhs back would they come to know i am diabetic in tehir tests if my sugar levels are in control? What would happen if they come to know i am diabetic at that point? would i be denied? Can i say i have been diagnosed after i applied for PR ? Will there be any test which determines how long it is since i got diabetes or that i am on medication through a blood and urine sample? I am even confused if i have to tell my lawyer that i am diabetic as i am sure he would not even refund the fee or if he will help me..

If any one who is diabetic got PR please let me know as that would be a big relief.

Please give me some advices. I am desperate.

Thank you.

Can someone be refused permanent residence in Canada if he/she has a medical condition such as atherosclerosis or diabetes?

Canada has a set of medical inadmissibility rules that determine who can be refused for immigration purposes. These medical inadmissibility rules describe circumstances, whether putting a burden on our health and/or social services or posing a danger to the Canadian population, that a visa officer uses to determine whether someone is ineligible to immigrate to Canada.
Relevant to your question is the rule called Excessive Demand Cost Threshold. Canada does not let people into Canada for immigration purposes whose health and/or social services costs it estimates will surpass this threshold.
So for example, someone with diabetes may or may not be deemed medical inadmissible depending on whether their treatment requirements are estimated to surpass the Excessive Demand Cost Threshold.

So in my understanding if your diabetic condition is very severe and you are currently spending lots of money yourself to be treated then it can be a problem during your PR assessment by Canadian Authorities.

However if its just genetic and you are not having any day to day complications that will not permit you to carry otherwise normal functions then it should not worry you. According to www.canadavisa.com forum there were many cases where people even with diabetes got through the medical assessment with little or no problems.

If you lie or not declare your medical conditions and then they find out in medical assessment that could have a very bad impact of your file. So its very much suggested to declare in advance which could have a positive impact on your file should an average or humanitarian officer handle your file.

All the best
