Employer Arrested For H-1B Visa Fraud..

[b]WILMINGTON[/b] — A Newark man convicted of forging immigration papers in order to have a large stand-by pool of workers from India for his technology company was sentenced to 16 months in prison by a federal judge Wednesday.[/size][/font][/color][color=#2C2C2C][font=Helvetica, Arial, sans-serif][size=4]
Srinivasa Doppalapudi, 46, a native of India with permanent resident status, warehoused at least 31 highly educated immigrants on fraudulent visas in Newark between 2008 and 2010. He promised them high-paying computer consulting jobs but often left them without work or pay for months, and sometimes years, while he waited to land consulting contracts.[/size][/font][/color][color=#2C2C2C][font=Helvetica, Arial, sans-serif][size=4]
Some eventually found computer work on their own, though they still had to pay Doppalapudi 25 percent of their salary as the H-1B visa holder, according to prosecutors.[/size][/font][/color][color=#2C2C2C][font=Helvetica, Arial, sans-serif][size=4]
Doppalapudi’s attorney, Edmund “Dan” Lyons argued that “90 percent” of his client’s business was legitimate and the shortcuts he took did not warrant incarceration beyond the four months he has already served. Lyons also argued his client is ill and had a heart attack in custody and so should be deported immediately.[/size][/font][/color][color=#2C2C2C][font=Helvetica, Arial, sans-serif][size=4]
A tearful Doppalapudi begged for mercy and said he just wanted to go home and be with his family.[/size][/font][/color][color=#2C2C2C][font=Helvetica, Arial, sans-serif][size=4]
Assistant U.S. Attorney Edmond Falgowski, however, argued that jail time was appropriate and necessary to send a message of deterrence to other employers who may be tempted to follow Doppalapudi’s example.[/size][/font][/color][color=#2C2C2C][font=Helvetica, Arial, sans-serif][size=4]
In court papers, Falgowski stated that this was not a one-time occurrence but a years-long fraud. Doppalapudi pleaded guilty to money laundering along with visa fraud.[/size][/font][/color][color=#2C2C2C][font=Helvetica, Arial, sans-serif][size=4]
While prosecutors recommended two years and three months incarceration, District Judge Sue L. Robinson said a lighter sentence of a year and four months was more appropriate.[/size][/font][/color]
