and client location lo you will be having a supervisor who assigns the tasks... client work client supervisor ey chusukuntadu...
but nee employer ki eppudaina ninnu aa work lo nunchi move chese right undhi... he can control your work...

"All the client specific work would be reported to me. The COnsultant would report all working hours, summary of work, etc etc, done to both Supervisor at Implementer/Prime Vendor and his employer"

[b]Petitioner, Employer, supervises the applicant and the supervision is off-site. [/b]

1.) If the supervision is off-site and performed by the petitioner, how does the petitioner maintain such supervision i.e. weekly calls, reporting to the main office routinely, or site visits by the petitioner?
[b]Mr. XXX is [i]not[/i] Volkswagen America employee but will be working as contractor and shall for all purposes be considered as an employee of Employer. We recognize the consultant to be an employee of Employer. Currently Mr. XXX is reporting to Employercompany manager Mr. YYYY by sending weekly reports and interacting with him on a needed basis. YYYY is responsible to review year end work-product of the beneficiary Mr. XXX[/b]

2.) Who has the right to control the work of the applicant on a day-to-day basis if such control is required?

[b]Employer company has the overall right to control the work of Mr. XXX. [/b]

3.) Who determines the direction of the project?

[b]Employer company is responsible for the overall direction of Mr. XXX work. As long as he follows Volkswagen America standard workplace policies, we will have no responsibility to dictate how he performs his job duties. Volkswagen America doesn’t have the ability to reassign Mr. XXX services. Only his employer has the authority to control and reassign his services. Volkswagen America outlines the work to be performed at our site and issues Statement of work (SOW) to the contracting companies. Employees from contracting companies should perform as per the issued Statement of work.[/b]

4.) Who determines the applicant’s daily activities?

[b]Employer company determine the Mr. XXX daily activites based on their weekly call with off-site manager. Employer company employees should perform the work at our location based on the issued Statement of work from Volkswagen America. Some of the daily duites Mr. XXX perform at our site:[/b]
[indent=1.1]· [b] Provide subject matter expertise to support teams regarding Informatica Web Services to assist them in setting future standards and support.[/b][/indent]

6.) Who hires, pays, and has the ability to fire the applicant?
[b]Employer company [/b][b] is reposonsible for Mr.XX [/b][b]payroll, hiring, firing, controlling his work; necessary insurance and any additional employee benefit according to relevant Federal and/or State Law, regulations or rules[/b].
7.) Who claims the beneficiary for tax purposes?
[b]Employer company claims the XXX for tax purposes.[/b]
8.) Who provides the beneficiary with employee benefits?
[b]Employer company provides the employee benefits such as Medical Insurance and Vacation to Mr. XXX[/b]

the main thing the VO/Consulate checks to see is employee-employer relationship.....whether the employer has every right on u to move/remove/pay/etc etc...since he is the one who has applied h1 petetion for u
