Who (you/preferred vendor/petitioner) supervises the applicant, and is such supervision off-site or on-site?

2.) Who has the right to control the work of the applicant on a day-to-day basis if such control is required?

3.) Who determines the direction of the project?

[b]Employer company is responsible for the overall direction of Mr. XXX work. As long as he follows Volkswagen America standard workplace policies, we will have no responsibility to dictate how he performs his job duties. Volkswagen America doesn’t have the ability to reassign Mr. XXX services. Only his employer has the authority to control and reassign his services. Volkswagen America outlines the work to be performed at our site and issues Statement of work (SOW) to the contracting companies. Employees from contracting companies should perform as per the issued Statement of work.[/b]

4.) Who determines the applicant’s daily activities?

[b]Employer company determine the Mr. XXX daily activites based on their weekly call with off-site manager. Employer company employees should perform the work at our location based on the issued Statement of work from Volkswagen America. Some of the daily duites Mr. XXX perform at our site:[/b]

5.) Who provides the tools or instrumentalities for the applicant to perform the duties of employment?

6.) Who hires, pays, and has the ability to fire the applicant?
[b]Employer company [/b][b] is reposonsible for Mr.XX [/b][b]payroll, hiring, firing, controlling his work; necessary insurance and any additional employee benefit according to relevant Federal and/or State Law, regulations or rules[/b].
7.) Who claims the beneficiary for tax purposes?

8.) Who provides the beneficiary with employee benefits?
