When a person who is working on H-1B status is willing to change jobs, the candidate needs to apply for an H-1B Transfer. A new H-1B petition needs to be filed by the new employer and it needs to be approved before the candidate can start working for him. This process is described as [b]“H-1B Transfer”[/b].

The transfer typically [b]doesn’t[/b] mean that the old employer needs to transfer something to the new employer, nor that the old employer needs to be notified of the new employer. The purpose of H-1B transfer is that the USCIS need to approve your transfer so that you can work for a new employer and this needs to go through the H-1B petition approval process.

The H-1B transfer process, after filing in general would take around 3-8 weeks when everything goes smoothly. This is a summarized list of documents required while applying for H-1B Transfer:[list]
[*]Copy of your most recent H-1B Approval (I-797)
[*]Few Recent Pay Stubs
[*]Copy of all pages in your passport
[*]All W-2′s and Tax Returns
[*]Copy of I-94
[*]Copy of Social Security Number (SSN Card)

[*]Copy of all previous H-1B approval notices (If you have H-1B transfers previously)
[*]Copy of current valid visa on your passport

As soon as your new employer files the H-1B transfer, you can start working for the new employer once you get the receipt notice.

[*]There is no H-1B cap for the transfer process
[*]H-1B Transfer doesn’t have any limit and can be applied any number of times

[b] [b]If I apply for H-1B transfer from company A to company B and decide not to change company A after my transfer gets approved, do I need to file a transfer again to stay with company A?[/b][/b]

This is not necessary. You can continue to work with company A irrespective of filing any transfer.
[b] [b]If I apply for H-1B transfer from company A to company B and the decision is still pending and now I decide to work for company C, what do I do?[/b][/b]

The company C needs to file for a new H-1B petition and request transfer. And you can start working for company C upon your receipt notice.
