Fica Tax Refund Help

I was no OPT in 2011 and my employer mistakenly deduced social and medicare (FICA) taxes for 6 months...I filed my tax returns this year (1040 file chesa) and sent in 843 & 8316 to refund me the FICA taxes.

IRS replied back saying that "if you filed 1040 ur a resident and not eligible to claim FICA"...If I file amended tax return (1040-A for example) I might lose the benefits I received as a resident and it will cancel off the refund I get on FICA.

since it is a mistake from employer side can I request him to file 941X? Evaraia chesthe please help me.
