[color=#1D1D1D][font=Arial, Tahoma, Verdana]The sixth accused in the case of December 16 gangrape and murder of a 23-year-old paramedical student in New Delhi was on Monday declared as a "minor" by the Juvenile Justice Board (JJB), which would enable him to walk free by June 4, this year when he attains the age of 18 [/font][/color][color=#1D1D1D][font=Arial, Tahoma, Verdana]years.[/font][/color]

The accused, who was described as the most brutal of the six accused by the Delhi Police in its charge sheet, was declared as 17 years and six months and 24 days-old (as of today) by the JJB, which relied on his birth certificate and school documents produced before it.[/font][/color][color=#1D1D1D][font=Arial, Tahoma, Verdana]
Section 15 (g) of the Juvenile Justice (Care and Protection of Children) Act mandates that a juvenile aged between 16-18 years if convicted of any offence can be sentenced to be sent to a special home for a period of three years at the maximum, and, thereafter, be released on probation.[/font][/color][color=#1D1D1D][font=Arial, Tahoma, Verdana]
However, section 16 of the Act also provides that a juvenile can only be kept at the special home till he attains 18 years of age and he cannot be sent to jail thereafter, which in effect will result in his release.[/font][/color][color=#1D1D1D][font=Arial, Tahoma, Verdana]
The JJB also rejected the police's plea for bone ossification test of the sixth accused for determining his age.[/font][/color][color=#1D1D1D][font=Arial, Tahoma, Verdana]
Lawyers appearing for the prosecution said they appeal against the JJB order in a higher court.[/font][/color][color=#1D1D1D][font=Arial, Tahoma, Verdana]
Earlier on January 15, the principal of the school, from where the juvenile had droppoed out, had submitted before the JJB that as per the school records he is 17 years and six months-old.[/font][/color]

So the guy who was allegedly most violent of the 6 could get 3 yrs max cos he's a juvenile!!! isn't his crime more important than his age? One can argue 'such is the law', but in this rarest of rare case, shouldn't an exception be made to set a precedent that no one is exempt. And what signal does this send to 17 yr old potential offenders...? Hurry up and commit your crime before you become an adult???!

His crime is mature and pre-meditated. Nothing juvenile about it... he must be tried like an adult.

it is such a shame tht hez gonna getta max of 3 yrs n thn gets a release to be free !

even thou hez violent among all the 6 @ this age !

the impact of the case and his participation should be considered rather than his age n othr stuff!

on the othr side it gives the freedom for other underaged people to commit thez kinda activities !

idi rape + murder. Adi kakunda National and international wide political pressure undi, more or less this is an important case in Indian history.

USA lo okka juvenile firts degree murder ki evi options

1) life in prison without the possibility of parole, 2) life in prison with the possibility of parole after 20 years has been served, 3) a definite term of 50 years in prison with the possibility of parole after a minimum of 20 years have been served.
