BobbyFischer Posted February 12, 2013 Author Report Posted February 12, 2013 [b]------ IDI HIGHLIGHT BABU MEEDA :- CAT ( central govt authority ) AKSHINTHALU ----[/b] The Central Administrative Tribunal has pulled up the Chandrababu Naidu government for trying to suppress the Yeluru land scandal by making a senior IAS officer the scapegoat and discriminating against him. The CAT quashed the suspension orders on IAS officer, Mr Sukhender Reddy. The government suspended him in 1997 for making excess payments towards land acquisition. "What is relevant is justification of discriminatory treatment and making him a scapegoat in order to show to the public that the government had taken action against an IAS officer, so that the entire matter would be wrapped under the carpet" it observed. The Yeluru land scandal has been a source of embarrassment for the government, especially after its 4 August order for the winding up of the Justice Somashekara Commission, set up to dig out the truth. Mr P Janardhan Reddy, former Congress Legislature Party leader, who has taken the issue to the Supreme Court said: "What more proof do you need that Mr Naidu is guilty in the Yeluru land scandal? Like the CAT observed why is he refusing to take action against the officers guilty of awarding excess payments from public money?" The order slammed the inquiry conducted by Mr K Swaminathan, principal secretary to the government, on the role of senior officers. The order says his report submitted on 18 November 1998 gave a "clean chit" to the senior officers. "A perusal of the report also shows that it was not a comprehensive enquiry as to the irregularities of the release of funds. A statement made by the said officers was accepted and the said officers were exculpated. It can't, therefore, be termed as an enquiry in a true sense as the said officers had not been cross examined or other witnesses were examined to find out truth of their allegations". On this the CAT said: "Hence the fact remains that Sri Justice Somashekara Commission's report wasn't finalised and no other report by way of comprehensive enquiry is in the hands of the government. In the absence of even a criminal enquiry against the applicant (Mr Sukhender Reddy), would the action of the government in selectively deciding to charge the applicant not amount to a discrimination?" It further said: "Can it not be said that the reasons on which some of the senior officers have been cleared, apply equally in the case of the applicant? Is it justified to charge the applicant to be proved by witnesses who are none other than the senior officers who took the crucial decision? "These are questions that arise in this case which deeply trouble us but we find no answer."
