On April 3, USCIS[/size][/font] [font=serif][size=4]announced that it had received enough petitions to meet[/size][/font] [font=serif][size=4]the congressionally mandated cap for fiscal year[/size][/font] [font=serif][size=4]2008 (FY 2008) and that it would conduct a comput[/size][/font] [font=serif][size=4]er-generated random selection of cap-subject petitions[/size][/font] [font=serif][size=4]filed on Monday (April 2) and Tuesday (April 3) to[/size][/font] [font=serif][size=4]determine which cases would be accepted for processing.[/size][/font]

[font=serif][size=4]As of April 9, USCIS has determined that approxima[/size][/font][font=serif][size=4]tely 119,193 of the H-1B[/size][/font] [font=serif][size=4]petitions received on April 2[/size][/font] [font=serif][size=4]and 3 are subject to the FY 2008 congressionally mandated cap.[/size][/font] [font=serif][size=4]USCIS received on April 2 and 3 a total of approxima[/size][/font] [font=serif][size=4]tely 12,989 cases requesting an exemption from the FY [/size][/font][font=serif][size=4]2008 H-1B cap because they were filed on behalf of a[/size][/font] [font=serif][size=4]liens holding a master’s degree or higher from a U.S.[/size][/font] [font=serif][size=4]institution. USCIS can now announce that the cap of[/size][/font] [font=serif][size=4]20,000 on these exempt cases remains open and that [/size][/font][font=serif][size=4]USCIS will continue to monitor these filings.[/size][/font]
