Murphy, Acting Assistant Commissioner, Customs and Border Protection officers will now be required to verify that each person seeking entry to the US as an international student has a valid SEVIS record. At present, SEVIS information is not available in “primary” inspection, that is, to the official on the line, but rather only in “secondary” inspection, that is, a site off the line where persons with complicated entry issues are interrogated. Since line officers cannot verify an active SEVIS record at present, this means that all entering students will be referred to secondary inspection until CBP can integrate its TECS and SEVIS systems, giving line officers immediate access to the SEVIS record. The time period needed for this integration is unknown, but it might be as little as a few weeks.[/background][background=transparent] Thus students should budget an extra couple of hours between air connections, or in order to cross a land border, until further notice. Moreover, students reentering with a new I 20 after termination of a prior SEVIS record (so called “reinstatement by travel”) should expect a full inquiry into the reasons why they fell out of status in the US, and should come armed with evidence that the status violation was beyond their control.[/background][background=transparent] This action comes in response to the admission to the US of Azamat Tazhayakov, a Kazakh student and friend of Dzhokhar Tsarnaev, one of the accused Boston Marathon bombers, whose SEVIS record had been terminated following expulsion from the University of Massachusetts. Tazhayakov has now been charged with obstruction of justice for helping to dispose of Tsarnaev’s backpack, containing empty fireworks sticks, from his dorm room.[/background][background=transparent] We will keep you posted as this situation develops.[/background][/font][/color]
