I think nuvvu ne degree ki and chestunna job ki link chupinchali which is pretty regular for employers talk to ur employer and u have very good chances of approval , All u need to do is respond to RFE ASAP and u will get an answer in less than 4 days.

Most of the time this problem arises due to bad job title or job description. To prove that the job falls under that category, you have to provide the evidence in one of the following The first way to convince USCIS that a job is in a specialty occupation is to prove that a Bachelor’s or higher degree in a closely related field is normally the minimum requirement for entry into the field. Check the Department of Labor’s Occupational Outlook Handbook (OOH) for your specific occupation with the specified job duties and see what it says.Because, the USCIS merely follow the OOH standards to decide specialty occupation. The second way to prove that a job is in a specialty occupation is to show that the duties are so complex or unique that a degree in a relevant field is required. This method requires a highly detailed job description and in-depth information about the employer. You have to do this anyway coz you have an RFE regarding employee-employer relationship. A third way to prove that a position is in a specialty occupation is to show that a degree requirement in a relevant field is common in the industry in parallel positions among similar organizations. Fourth way to prove that the job is in a specialty occupation is for the petitioning employer to show that his or her firm normally requires a Bachelor’s degree for that kind of position. I have no idea about your relationship with your employer and so, i cannot explain the best way out of it. You have to provide more details on it. Good Luck!

Terminator II Posted June 5, 2013 Report Posted June 5, 2013 speciality occupation and employee- employer relationship rfes are common.. Dont be too worried.. Your client letter should clear state about you job description (that some one with a masters degree or equivalent exp in that particular field can only perform the job duties) and your relatioship with your empoyer (that all the hiring, firing, work assignment, status reporting is controlled by ur employer but not client). If your employer is someone who has filed many H1b's before, He should be able to answer this easily.
