ICANWIN Posted July 8, 2013 Report Posted July 8, 2013 I might have to go to India in december but my h1b visa ( got stamped on passport in vancouver 6 months back) is expiring on jan 4th and my passport expiring in dec. I applied for re-issue of passport and applying for h1b extension once i get it. My employer says if i travel back before jan 4th i do not need a new visa stamp on my passport to re-enter US. But, i suspect i need a visa stamp to re-enter with a approved h1b extension even before jan 4th. Did anyone encounter this situation and is it true that we do not need stamp to travel back on valid h1b visa with approved h1b extension? If i need a stamp then i would prefer to apply premium in dec and make early travel arrangements to avoid stamping again. Evaranna ila velli vachunte please help! I know I cannot travel without valid passport for 6 months and valid visa for 1month on h1 and re-enter US . I m asking here incase of re-issued passport and approved extension .

[/quote] r u sure...i have seen people entering on sep 28th with sep 30 being their visa expiration date....i think they had an approved i797...but im not sure

Port of entry Lo they will send us back without Atleast 1 month visa on h1 and Atleast 6 month valid passport . He might just got lucky or had approved h1 b extension . But did he got stamped again ? This would answer my question

Asalu valid unte question emundi why and how he will stop ?

POE lo adhey adigithey already application is ready for extension they are going it file in couple of days antey... ok thats fine just want to make sure that you know that your visa is expiring ani annadu ...
dotnetrockz Posted July 8, 2013 Report Posted July 8, 2013 @icanwin....nuvvu reverse chepthunnavu....they may sent back you on f1 if your travelling in ur last 6 months on ur f1 expiration (there are cases i heard in DB).....but for h1b....i think they'll allow only if you have a i797 ext approval

[/quote] Monna recently ma cousin vachadu he was made to sit for 4 hrs and was questioned how he is entering with h1 b being valid only for 15 days . Why Shoukd we allow you Ani champi last ki pmampadu ta .i94. Kuda 15 days Ke valid chesadu . Anthe kadu extension ki applied in process ante how are u confident that it will prove deny kuda avvachu ga anandanta ... Approval lekunda travel is very riskyat that last minute of expiry
