kolan Posted July 9, 2013 Report Posted July 9, 2013 my H1 in pendigng status and want to go India next month on OPT, Below are my questions 1) If i get H1 approval , can i come back to US on OPT ? 2) My H1 Status starts from Oct 1st , is my OPT valid till October and can i come back on OPT status? Please repsond experts ASAP.Thanks
CooLgUy4U Posted July 9, 2013 Report Posted July 9, 2013 If you get your H1 approved.... u should go for stamping and can enter US only after Oct 1st........and ur F1 status changes to H1 and u no more a student...... lets wait what others say...

Please repsond experts ASAP.Thanks [/quote] When your case is in pending status,,,,,,,Then you can't travel, Why because your I-94 IS NO MORE VALID, ,, But one thing,,If your OPT IS VALID,, YOU CAN COME BACK BUT YOU will receive a letter from USCIS AS SOON AS YOUR OPT EXPIRES (for example,If your opt will expire on Aug 20, You can come back before that date and Have to leave and re enter on or October 1st, If your H1 is approved, don't count on CAP GAP in this scenario).

Please repsond experts ASAP.Thanks [/quote] H1 Status Pending untey kastam bhiyya... - If changed to [b]approved status[/b] before you come back, then u will be fine. stamping emi akkar ledu... u are just travelling on OPT or CAP GAP. and Immig guys will allow you checking ur updated Sevis n OPT I-20 - If still in [b]pending status[/b] or RFE (in the worst case).... then u will be in big trouble.
kolan Posted July 9, 2013 Author Report Posted July 9, 2013 I got RFE and that answered couple days back, I am leaving July 31st to india and planing to come back on Aug 31st. I have option 1) I can upgrade my case to Premium process, i can get aprroval befor july 31st( Before leave the country) Questions: Can i travel out of the country once i get the approval, is my OPT still valid to come back?, My friend saying that once i get H1 approval even that starting from OCt 1st, I cant come back on OPT, i need to go for stamping and need to come back after Oct 1st. is that correct?
