he is not convicted yet, court has to give its final judgement, it all the cases are proved, if he get punishment from court then only he is not eligible to contest

case prove ai doshi ga jail lo 2 yrs kanna ekuva untene not eligible.. ipudu jst remand no case proved

Ledhu ba..Jail lo unnanthakalam elections lo poti cheyyaledhu.. Monna supreme court cheppindhi enti ante...person who has no right to vote has no right to contest election ani...adhi..mana parliamentarians eppudo pass chesaru...voting gunrunchi (or mana rajyamgam lo already undho)...aithe...inko rule enti ante...the person who is in jail will loose the voting right..vaadi case prove ayina ..lekapoyina..automatic ga vaadi voting right pothundhi. Ee lopu bail meedha bayataki vasthe poti cheyyochu..endhukante..automatic ga voting right vasthundhi.. .

elections appudu dhooragam ga unna employees (who are on election duty) votes...aina postal ballot lo..theesukuntaaru kaani...jail lo unna valla votes theesukoru...

Jail lo case prove kakunda unna valla gurunchi ..mana lawmakers correct laws emi cheyyaledhu parliament lo..andhuke ee uncertainty. So supreme court gave good judgement based on the law defined by the constitution and the parliament.

Irrespective of whether a person is proven guilty or not..........if he /she is in the jail at the time of elections...then that person can not contest. Bottomline is if a person can not vote...then he/she can not contest.

no bhayya... 1st nenu ilane anukunna news lo kuda ilane vachai articles bt matter enti ante case prove ay 2 yrs kanna ekuva unte he is not eligible... 2 yrs kuda enduku annaru ante 2 kanna ekuva yrs judgement padite avi pedda case ani conclde avutaru anta..

Article 326 of the Indian Constitution mandates adult suffrage, which means that every person who is a citizen of India and who is not less than 18 years of age can vote. However, India is one of the few countries in the world which does not allow prisoners or under-trials to vote. Section 62(5) of the Representation of the People Act, 1951 (ROPA) prohibits all those who are confined in a prison or are in lawful custody of the police from voting.[/font][font=Georgia,]
The aforementioned provision has been challenged on the grounds of Article 14 of the Constitution. In [i]Anukul Chandra Pradhan[/i] v. [i]Union of India & Anr[/i], the Supreme Court observed that in view of the settled law on the point, it must be held that the right to vote is subject to the limitations imposed by the statute (ROPA). Further, in [i]Mahendra Kumar Shastri[/i] v. [i]Union of India and Anr[/i], [(1984) 2 SCC 442] the Supreme Court observed that the restriction imposed by the ROPA was not unconstitutional and was in public interest. In a decision of the Patna High Court, [i]Jan Chaukidar (Peoples Watch) [/i]v. [i]UOI & Ors.[/i] [2004 (2) BLJR 988], the Court said that the right to vote is a statutory right. The law gives it, and the law can take it away. These views of the Courts against prisoners’ suffrage have been upheld in more recent cases such as [i]Rama Prasad Sarkar[/i] v.[i]The State Of West Bengal & Ors[/i]. In the year 2010, the West Bengal Government lobbied for prisoners to get voting rights. In Bihar as well, efforts were made in the same year to ensure that under-trial prisoners lodged in various jails of the state got voting rights and took part in the elections to the State Assembly which were to be held in October-November. Though there are Court judgments talking at length about the human rights of prisoners and under-trials, there has been little change as regards the stand on their voting rights. India must reconsider the blanket ban on prisoners’ suffrage and consider involving the Election Commission along with the Courts in order to ensure a more progressive law on the issue.[/font]
