Car Accident With No Injuries, The Other Driver Making Injury Claim

Recommended Posts

Hi,
I was involved in a minor accident with no injuries to both the parties. It was my mistake and I got a ticket for that.
The other driver had no injuries at that time and was walking and talking properly after the accident.

Also in the police report, nothing was mentioned about the injuries.

Today I got a call from my insurance saying that the other driver has hired an attorney and filing for injury claims against me and the insurance.

Can you please help me what is going to happen?

Thanks

Recently had the same experience. I rear ended other guys old car. cops didnt come so no ticket. he was fine then. later while claiming insurance he mentioned he had to go to Dr etc etc ani oka range lo bill vesadu.

I spoke to my insurance what next ani. then said first they will see the impact of both cars and later decided whether it is logical for him to claim medical as the impact in my case was very less. My car expenses 800 his car was 850$.

So in the end my insurance paid him total of 2000$ for repairs and medical then claim closed.

My insurance gave me process like this.
1) Check the impact of accident
2) Speak to other party about medical claims
3) insurance will decide based on both parties illustration of accident and car impact vs medical claims
4) If other party goes for Court first insurance will appear on my behalf
5) only if Court asks me to come then only im supposed to go or else not needed

Mine was all state insurance. Claim closed but insurance raised 50$/month. :(

Chill boss..... check with insurance they should be able to explain about the procedure.

what you said is correct

the other person might not see any medical related injuries internally or externally at the stop
later they might feel anything.
just to make sure, they will say they have to consult to a doctor.
this is pretty normal in US
and i request you to do the same, if you feel you ever involved in a colliion, don't say upfront you are ok, just say you will have to check with the doc

Thanks for the inputs. I checked with my insurance. They said they will help me in this matter.
But what worries me is that the other driver has hired an attorney and not speaking with anyone(even the insurance) without the consent from the attorney.

I think they might be planning for more claim amount (including the attorney charges).

In this kind of cases ... Attroney will hire a doctor he.. will give some falise reports likw whiplash, restriction of motion of joint some blah blah... and finally they manage to get some money and share it among themselves... Your premium is going to increase whenever you are going to buy insurance next time

I guess your mistake is not calling cops is it right ??
