I assume its a random act of publicity by an over enthusiaistic lawyer or on the other hand, congress plan to delay proceedings until next elections.

It is a plan indeed because now they will be forced amend constitution. Remember amendment needs 75% unanimous vote unlike 50% in other cases. Thre is no way to get 75% because all allies nd oppositions of UPA who are facing issues like vidharbha, bodoland, goorkhaland MPs may not support bifurcation given the troubles it may cause in their respective states. Moreover, it is highly doubtful if bjp co-operates with elections in less than an year
