ranjith23 Posted August 26, 2013 Report Posted August 26, 2013 Bhaya its nothing but INITIAL REVIEW. I also filed for MTR and have the same status. it takes anywhere between 2-6 months. But after OCT 1st you can expect in 2-3 months because most of H1B reviewing people at USCIS will be free as most of the cases would have been either approved or denied. so they all will start working on these MTR's and appeals Did you file motion to reopen OR motion to reconsider? and also curious to know why was your H1b denied?

[/quote] usually the officer who denied your H1b only will look into your MTR case again (90%). [b](1)[/b] if he thinks its worth to approve (looking at your additional documents or if you prove legally), then he can directly approve and he dont needs anyone approval for a change of decision from denial to approval. [b](2)[/b] if he still wants to deny (not convinced even after looking at your additional documentation), he "CANT" directly deny your case. he needs to first get approval from his supervisor (his boss...like LEAD) that his decision to deny is right. His manager also goes through your case thoroughy and if he aggrees that his decission to deny is right. then only your MTR is denied finally. [b](3)[/b] but If the supervisor thinks its not worth denying or else if he thinks its 50-50, then he will send your case for final inspection to "Administrative Appeals Office for review" (who are the ones who finally decides whether to approve or deny). So I think you are in condiiton[b] (3),[/b] thats the reason i said your case is nothing but "INITIAL REVIEW" It can take anywhere between couple of weeks to months to get the final result. this all information is according to my research and knowledge bhaya as i'm also on same boat as i even filed for MTR
