On August 26, 2013, we transferred your I290B, NOTICE OF APPEAL TO THE COMMISSIONER, to your local USCIS Office for further processing. The new office has jurisdiction over your case and will send you a decision as soon as processing is complete or you will be notified if further information or action is needed. [color=#282828][font=helvetica, arial, sans-serif]usually the officer who denied your H1b only will look into your MTR case again (90%).[/font][/color]

[b](1)[/b][color=#282828][font=helvetica, arial, sans-serif] if he thinks its worth to approve (looking at your additional documents or if you prove legally), then he can directly approve and he dont needs anyone approval for a change of decision from denial to approval.[/font][/color]

[b](2)[/b][color=#282828][font=helvetica, arial, sans-serif] if he still wants to deny (not convinced even after looking at your additional documentation), he "CANT" directly deny your case. he needs to first get approval from his supervisor (his boss...like LEAD) that his decision to deny is right. His manager also goes through your case thoroughy and if he aggrees that his decission to deny is right. then only your MTR is denied finally.[/font][/color]
