better CBP Office ki velli appointment thisukunte best......but cannot say already 3 months overstay kindhaku vasthundhi but something is fishy mee vadi i797 expiry eppudundhi?

Visa is for Entry
I-94 is for stay
H1B is status

H1B apply chesinappudu they will give new I-94 if that is valid then he is good.

otherwise he extended his stay and i think there will be 90 0r 120 day grace period..ee loga he has to apply for extension of stay I guess...

but the more days he stays with expired I-94 the more damage it will be for him in case of GC processing....queries padathai as to why he didnt leave, why he didnt apply for extension etc etc...

The best option is he can exit USA to canada and return back with new i-94
While entering just tell the CBP officer that you have turned in the i-94 to Canadian officials (act that you were not aware etc..cos if you are visiting canada or mexico for duration less than 30 days you need not surrender your i-94 at the border)

cos ,you do not need to return the i-94 if you visit canada for a short trip and the Canadian border police will never ask for i-94
You will not come across the US immigrations while you exit US/CAN border
