Need Information On My Old H1B Application

Hi Friends,

 

nenu h1b apply chesanu in 2006 from india consultancy, got 221g query paddadi asking for client and project details, but consulantanncy vadu edo dummy project ichadu, adi submit chesanu to chennai consulate,one year wait chesanu, no result. tarvata light teesukona..

 

I am from india, I never visite USA till now.Now i want to use that old h1b application with new employer(still searching)

 

My Questions:-

 

1. Can i use my old h1b application(I797C) with new employer,?

2. Is the employers initiate old h1b application with giving all client and project details?

3. What documents required for initiating to new employer?

1)exact date cheppu cheppu ...i guess nee petition 2006 lo file chesi unte already 6 years datindhi so nuvvu cap kindhaki vasthavu....

inshort u cannot transfer the petition in 2006 to a new employer now...u have to apply in cap...

 

But as always take some attorneys advise...

3)nee side nunchi just nee educational stuff...employer has to provide the assignement details,offer letter and stuff...

nee doubt new employer old h1 ni invoke cheyyadam gurinchi aithe....new employer has nothing to do with old h1 petition or project or client......in short he has to file a new H1 (nee old h1b petition ni use cheyyaledu....by providing client and projectd etails)

 

he can only use it to mention that ur already have a h1b petition filed....so iam transferring based on that petition......(but nee case lo any ecperienced attorney ne cheppagaluguthadu what can be done nai)

The USCIS generally only considers an H1B applicant counted against the numerical H1B cap if s/he is physically present in the U.S. when the change of status to H1B takes effect or s/he is issued an H1B visa from a U.S. consulate abroad. Absent one of the above the USCIS may deny a new H1B petition filed as cap exempt. However, we have seen situations where USCIS has approved the H1B petition as cap exempt after disclosing that no visa was issued.

As per the rule, Any one who has Perm filed and I140 cleared and extension applied comes under the provision of AC21 ( Does not have to be after 6 years as per Murthy Law firm ), So this will have good number of people in this bracket.
