Silent_Boy Posted March 14, 2014 Report Posted March 14, 2014 While switching employers after I-140 approval, will I get a 3-yr extension with the new employer? Answer: If the I-140 priority date is not current, it is possible to get three-year extensions beyond the six-year limit with ANY employer. Thus, if the new employer requests three years, and can show the USCIS that the employer-employee relationship will extend for that three year period (this is an issue in IT consulting cases), then the USCIS can approve the three-year extension. Example: current employer tho 140 approve ayyi, H1 3 years extension approve ayyaka, 1 year current employer tho work chesi kotta employer tho H1 extension cheseppudu we can get again 3 years and not 2 years... good point
