The head of a Santa Clara, California-based IT outsourcing firm was arrested and charged with immigration fraud this week as part of an ongoing government crackdown on alleged abuses of the high tech visa program.

Patwardhan falsely represented to the government that the 19 H-1B visa applicants had high technology job offers with an American employer, when he knew there were no job offers for those individuals.

WSJ: Balarkishan Patwardhan, the 52-year-old head of BCG Consulting, was arrested Monday and charged with making false claims in an attempt to procure tech worker visas for 19 employees.

Patwardhan falsely claimed on visa applications the computer system analysts and programmers he was sponsoring had full-time job offers and salaries. In reality, the government says, the full-time jobs did not exist. 

ICE.gov: Patwardhan falsely represented to the government that the 19 H-1B visa applicants had high technology job offers with an American employer, when he knew there were no job offers for those individuals.

Patwardhan's next scheduled court appearance is April 22 before U.S. District Judge Edward J. Davila. The maximum statutory penalty for visa fraud is 10 years in prison and a $250,000 fine.
