Na wife ki  Full time set ayyela undi.....opt to h1 marabotundi.....She applied for h1 this year.....Ipudu FT interview ok aite....h1 receipt vachina ventane transfer pettukovacha? FT company ki receipt number istey they can do processing from their side ani vinnanu.....Is that true?

AC21 portability for H1b prakaram, If a filing for H1b transfer was filed before the job start date i.e Oct 1st, the person can use AC21 and start work with employer B without working for employer A.

AC-21 permits certain individuals originally authorized to perform H-1B employment with one employer to commence H-1B employment with a new employer upon the filing (not approval) of new petition if:

A. they were lawfully admitted into the United States;

B. their employer filed a nonfrivolous H-1B petition for new employment before the expiration date of their authorized period of stay; and

C. subsequent to such lawful admission, were not been employed without authorization in the United States before the filing of such     petition.

H1 confirmation vachi I797 form thone H1 transfer ki apply cheyochu... appati varaku OPT meeda work cheyochu... but if she is on cap gap OPT she cannot... she has to wait until the old H1 approval...

vaallu revoke cheste prob vundadu... as long as u have applied for a transfer and got it approved... elago OPT Oct16th varaku vundi kaabatti... she can start working for FT on that OPT ... and once u get the previous H1 approved, u can apply for a H1 transfer with FT job ... she can continue working meanwhile...
