media misleading the people saying only AP has that. Today saw a news item in Eenadu saying one of fish food co shifting to vizag due to tax excemption

 

 

Why special category:

 

tax incentives will be given as part of 'special category status' to be given to seemandra region(state).. it comes with the approval of planning commission and the criteria considered will be "Economic and Infrastructural backwardness and Non viable nature of state finances "

 

but there is legal problem .. here

 

"shall" , " appropriate" - they don't mean compulsory, tax incentives... - they did not include word special category in the bill intelligently

bihar and orissa are asking for such incentives since long for the same reason of backwardness... if tg is given without legal backing then it may be challenged in sc(which i am not sure) as special benefit for one state means loss for other which is against federal spirit... there may be political bickerings on this matter but sc may quash it iff its found inappropriate... tax incentives is a sensitive issue not given so easily

 

 

Special category status to states has changed definition time and again. Ultimately the NDC will decide. The GoM dealing with Bihar's request said "Bihar
can get rid of present backwardness through proper utilization of its geographical and human
resources assets". The definition and parameters for special category has been changing ever since Dr. Gadgil proposed in the fouth five year plan. Appropriate fiscal measures do not come into picture only when the state is in revenue deficit. States have heavy fiscal deficits though they are revenue surplus.

In essence, no standard procedure or a set of objective parameters are put in place for deciding special category. Infact, almost all the current special cateogory states have revenue surplus from 2007-11 except for two which had a zero deficit. There could be other forms of tax incentives. Lets see.

so far special category status given to states that include the seven Northeastern states (Arunachal Pradesh, Assam, Meghalaya, Manipur, Mizoram, Nagaland and Tripura), Sikkim, Uttarakhand, Jammu and Kashmir and Himachal Pradesh.

most of these are given special status because they share border with foreign countries; low density of population and hilly terrain come next in the priority and i am not sure non- viability nature of state finances is considered so far to be a major factor...
