If you are on H1-B ,Your employer has to pay you even on bench or with out any work/project

May be he is running pay roll and deducting tax and depositing to IRS

on OPT, actually your employer is not even oblized to pay you ,leave alone tax

He can deduct tax only on the amount paid to you.So no question of deducting any tax when he is not running any pay roll or not paying when you are on bench

The employer should contribute the 9-11%(depends on the state) of payroll amount. If the payroll run for $5k, the employer has to pay around $500 (employer tax)..that is excluding our tax deductions (like around $1100, again depends on the work location/payroll state).
