I have applied H1 Transfer to an Employer Consultancy ( C ) in the month of July( This would be EVC model). Till July i was with a Desi Prime vendor(B)( This was a VC Model). I have the stamping and valid I797 till Dec 2014, with 'B'. My H1 Transfer with 'C' still in Initial Review. Two days back i traveled to india because of family emergency. May be mid of sept, i can fly to US. Please tell me . which is the better option/ suggest me 1. Can i enter to US , with out stamping. means can i show the previous I797 with Vendor B and re enter? 2. Or do i need to wait in india till the H1 Transfer approve and further need to go stamping , then travel to US? 3. OR can i make the H1 Transfer to premium and after that stamping ,then travel to US? Please suggest me best option with risk associated or any other options to re enter to US without any hassle. Thank you.

dotnetrockz Posted September 3, 2014 Report Posted September 3, 2014 with that old visa u shud be able to enter ...but nuvvu already start chesavu work cheyyadam C ki without approval...so its better to get approval and then re enter...ikkada inkokati processing madhyalo u left so okasari nee h1b apply chesina lawyer ki email cheyyi...what will be the bets option to re enter....premium endhuku cheyyinchaledhu?

Nenu patha I797(with vendor B) tho vasthe POE daggara latest paystubs adagara? and naa passport# enter chesthe vallaki telisipodaa?? please tell. there are 50-50 chances......some cases they dont ask for pay stubs...if your I797 is valid and shows up in system they are ok.. if they ask for paystubs and is different then problem... So better wait for approval of the new employer or chance of risk........

If you have valid stamping from old employer...you need not go for stamping.. but you should show new approval notice.....
