If you are unable to get experience letters from your previous companies.Below is the response from one of the attorneys

 

"The ideal option is to obtain an experience letter from the employer which states that your were was full time and includes his title, start and end dates of employment and a detailed description of the duties, either signed by your former manager or the HR department.  The second option would be a letter from a former manager that no longer works at the company which states that he was your manager at [name and address of company] and therefore has knowledge of his experience.  The third option would be a letter from a former co-worker.

Options two and three (especially option three) are accepted at the discretion of the USCIS and additional documentation should also be submitted such as evidence of attempts to obtain a letter from the employer, and their response, plus any other documentation to evidence he was employed at the company.

If the former employer is willing to sign a letter just confirming your title and dates of employment which is then supplemented by a more detailed letter regarding his duties from a former manager, this would be acceptable."

title shud be GC instead of H1B assuming why wud u need ur prev emp letter to file/extend/tranfer h1b...u just would need the paystubs and i-797

usual gaa ikkada h1b visa midha unde valla problems and vaatiki parishaaralu update chedhamani naa thought..

Bhaiyaa its happened to me

 

I left my previous employer he didnt pay me almost 45 days.

i was on h1b with him.... 

 

i requested my employer begged him, pleaded at last i warned that i will go to USCIS / DOL ani. Desi lanjakoduku ivvaledu. 

He was paying me 75-25 and on top of it payroll $1 + marketing team ki $1 and if Perdiem run chesthey .75 cents cutting and i paid my own h1b.

Now this was frustrating, I had no other way so i approached DOL. They registered a petition. My employer gave back all the money except h1b processing.  

 

All my friends suggested not to go for USCIS/DOL. just warn him or leave it.

they even asked me if your employer might complain you frauded him with 8yr exp or running taxes in different state etc etc..... All are bullshit.

Just think he has lot of employee and just for sake of one he cannot mess with you. Nee okkadi gurnchi vani pota meeda kotukoledu. and he might be doing many illegal things at his back too with others.

 

 

It is very simple bhaiyya, believe me it will not harm you anyway. This country is employee friendly not employer friendly. 

first go with all the timesheet and your previous paystub and a pring copy of yoru email leaving the companu and submit them all to nearest DOL.

In my case i used to work in Dallas TX and left comapany and moved to Florida.

 

spoke to DOL officier in florida my previous employer didnot pay around 9,000$

DOL officier: As per DOL we will take case upto 5,000$ not more than that if your employer need to pay you more hire an attorney annadu.

Me: i filed a petetion for 5,000 in FL.

DOL officier : are you sure you want to file petition ani adigadu

Me: without second thought i said yes.

DOL officier: asked me all paystubs, offer letter, etc etc

Me: submitted

DOL: ok you will receive a acknowledgement in 4-6 weeks and the same time your employer will be notified annadu.

 

Petetion was registered. 

 

Surprising after 5th week of petetion. ,y e,ployer was calling i didnot lift he sent email please  call me i will settle money annadu. i didnot respond.

one day he called me around 7:00 am and saying.

 

Babu garu  :P i was trying to reach you since 3-4 days. If you have time lets settle your money issue annadu and asked me take my petition back.

he said he can pay me only 4,000 as he incurred losses on me and said some bullshit stories.

 

i was rigid for $9000. he paid me $9000.

 

DOL ki okka chinna complaint vachina vaniki 3 back and front years audit avuthadi anta.

 

Bhaiyaa last request dont hesitate to go back. id needed contact me.

maa friend current oka desi employer ki pani chestunnadu...vadu chala ekkuva % tintunnadu....my friend wants to come out of that company....

prime vendor kuda maa friend gadiki support chestunnadu...but vendor does not want to be in the loop(meaning, vendor can not call employer and say project ayipoindi)

 

kani vendor is okay if my friend wants to work through a different employer....

 

how to come out of the situation....current employer gadu three years undali ani paper meeda sign cheyinchukunnadu....

 

if my friends sends two week notice, then current employer may not pay salary....and can ask us to pay because we ended the bond in the middle...

 

if my friend says project ended...employer may get doubt...is there any chance that employer can skip paying, and if we go to court, employer can say " because he lied, i did not pay"..

 

could you please advice on the safest way and easy way to come out of this situation.......

3) pay for example 1 st na pay chesaka, H1 transfer ki chusipettukunna employer ni initiate cheyya manadamu.

 

4)timesheets ki call chesthadu patha mesthri. time sheets pampa kudadu patha mesthri ki.

 

vendor ki munde cheppali. naa pay approved time sheets lekunda ivvanu ani.

 

polite ga nice ga phone lo work lo busy vunna/mgr/team lead vaccation ki poyadu ani cheppatame.

 

5) H1 premium lo 15 days ki transfer avvuthadi or even reciept vachina kotta employer tho pay run cheyyinchukovachhu.

 

 

patha employr ki notice lu thokka tholu waste baa.

 

silent ga tappiyyatam best.
