Lets say Iam working for a "ABC" company(ABC company is a big firm lets say fultime) and Client is "DEF". Iam planning on transferring to a small consultancy "XYZ" and find a new job at some client "UVW". "ABC" is holding my H1 Visa, Now If want to resign or quit the job at "ABC" company I will have to give a notification period of 2 weeks. Iam just thinking about multiple scenarios and making some conjectures based on information feeded to me. Lets say I started marketing to find a new position anywhere in USA and Lets say I found an Opportunity at some client place "UVW". 1--I don't want to move out of my current company until I get a good opportunity 2--Its kind of mandatory to give a 2 weeks notice at my client place since the work is more reliable on me. Questions: 1: Is there any possibility of H1B transfer getting rejected? 2:I do know that it would take a minimun of 5 days to get the approval of LCA and minimum 2 weeks for H1B Transfer approval I would say to any vendors If they ask me "when can i start" i would say 15 days because I have to give a notice. Once I get a job and If i give a notice at my current company "ABC" and move to a new job "UVW". I know that I could start working on the receipt of H1B transfer application but still i don't have approval. What if H1b Transfer gets a query?? What If my H1B Transfer gets rejected??? What if Client doesn't provide me Client Letter?? I know that many people change emplyers working at current client but my scenario is entirely different as Iam changing the entire phase here. Please advice I do know that I can't go back to "ABC" since I had already given a notification period they might revoke my h1B. Please do suggest what should I do? Could you guys explain how to overcome this scenario. Thanks in advance
dotnetrockz Posted October 15, 2014 Report Posted October 15, 2014 u have answered ur question in the last line.... serving notice is client by client basis........it may eb 1 day or 1 week or 2 weeks...that will not impact ur h1b but may impact the client and abc's relation..... h1 trasnfer is nthng but applying a h1 petition out of the cxap...rejection can be due to ur employment or any otehr factors....if u get rejected u can still stay with abc if he hasnt withdrawn ur petition lastly ur working with abc for client def isnt this the same consulting or desi employer model..how is it FT job?

Thanks in advance best thing to do is go on vacation and in mean time your h1b will be approved .You will have a buffer of 6 weeks for your h1b transfer
