The Solicitor General of India is present in pursuance of our request as contained in the order dated 14.10.2014.

The learned Solicitor General points out that in the order of the Tribunal passed on 2.9.2014 there is already the observation that the petitioner’s rights guaranteed under Article 19 (1)(a) and 19(1) (g) stand infringed as the result of its channel being taken off the air in the absence of any order passed by any lawful authority. He further points out that the order of the Tribunal passed on 22.9.2014 records the solemn statement made by Mr. Ramachandra Rao, Additional Advocate General for the State of Telangana that on resumption of the broadcast of the petitioner’s channel, in case of any threat of violence, the State of Telangana would do all that is required in law to provide sufficient security to the MSOs and LCOs broadcasting the channel, as long as the broadcast did not violate any law or indulged in making any defamatory references to the State of Telangana, its people, its government and its elected representatives. The learned Solicitor General expressed regret that the assurance given by the additional Advocate General was not matched by any robust action and resultantly the order of the Tribunal passed on 2.9.2014 and the assurance given by the Additional Advocate General on 22.9.2014 have so far remained mere words on a piece of a paper.

At this stage it may be noted that though on the previous date the State of Telangana had chosen to remain unrepresented, to-day Mr. Ramachandra Rao, Additional Solicitor General for the State of Telangana is once again present. He states that the State has taken steps to provide full protection to the MSOs who should resume the broadcast of the petitioner’s channel as directed by the Tribunal. He produces before us a letter dated 25.10.2014 from the Chief Secretary to the Government of Telangana to the Director General of Police, Telangana. The letter reads as under:-

“The attention of the Director General of Police, Telangana State, Hyderabad/Commissioner of Police, Hyderabad is invited to the references 1st to 7th cited and enclose herewith the copies of the references 8th & 9thcited and they are requested to give full protection to the personnel and properties of respondents No.1 in Petition No.347(C) of 2014 and Petition No.440(C) of 2014 i.e., Siti Vision Digital Media Pvt. Ltd., Hyderabad and Hathway Cable & Datacom Ltd. and others, and to ensure that no untoward incident takes place as a result of the petitioner’s broadcast as per the orders of Telecom Disputes Settlement & Appellate Tribunal, New Delhi dt. 02.09.2014 and 22.09.2014 in Petition No.347(C) of 2014 and Petition No.400(C) of 2014 and intimate the action taken to the Government.”

Mr. Mehta and Mr. Bhatia Counsel appearing for the MSOs (the respondents in the two cases) submitted that the letter produced by the Additional Advocate General is from one office to another office and would by lying in some official file, completely unknown to the general public. They submitted that even if the concerned officers were sincere in following the directions contained in the letter they will come to the MSOs rescue only after the MSOs had suffered damages at the hands of unruly mobs who continue to believe to have the political sanction to “punish” any MSO broadcasting the petitioner’s channel. Mr. Mehta submitted that in case the State Government issued a public notice or a press release warning against any use of violence against any MSO for broadcasting the petitioner’s channel, that would make its intent clear and well known to all and sundry and the MSOs will be able to resume the broadcast of the petitioner’s channel without any apprehension of violence.

The learned Solicitor General suggested that the State Government should be asked to file an affidavit incorporating the statements made by its Additional Advocate General before the Tribunal (as recorded in the order dated 22.9.2014) as also the contents of the letter dated 25.10.2014 from the Chief Secretary to DG Police. He submitted that no State Government would like itself to be seen in breach of an affidavit filed by it in a court/Tribunal and would feel obliged to act in accordance with the directions given by the Tribunal.

We are in agreement with the suggestion made by the learned Solicitor General. We, accordingly, direct the State of Telangana to file an affidavit to the effect that as long as the petitioner’s channel abides by the Programme Code and the Advertisement Code as prescribed under rules 6 and 7 of the Cable Television Networks Rules, 1994 and as long as it does not indulge in making any false and malicious references to the State of Telangana or its people or its government or its elected representatives, the State Government shall ensure the smooth broadcast of the channel by the MSOs without any untoward incidents. The affidavit should also incorporate the contents of the letter dated 25.10.2014 from the Chief Secretary to the DG police. Such an affidavit must be filed by 5.11.2014.

Apart from the direction to the State Government, the petitioner and the respondent MSOs are also directed to give wide publicity to this order though publication and through the electronic media. The publicity given to this order should allay the misgiving of the MSOs and the MSOs would then be in a position to resume the broadcast of the petitioner’s channel as directed earlier.

The MSOs shall also intimate the Director General of Police, Telangana State, and the Commissioner of Police, Hyderabad in regard to the date and time when they will resume the broadcast of the petitioner’s channel. 

With the aforesaid safeguards, the MSOs should resume the broad cast of the petitioner’s channel within a week from to-day.
