I think there is a slight difference..

if you have already come to USA 'legally' you are documented .i.e. you are ID'd and figureprinted ..and what Obama is talking about is those who are undocumented (crossed the border and not in govt records) and I think the amnesty will be for those and not who are out of status by overstaying..these will be deorted and not eliigible for applying for immigration ..unlsess they apply in other criteria like aslylum or as refugees

yes..you can not get..

Few decades back,many people used to come from India (punjabis and gujjus) to US legally and illegally and use to apply for GC on refugee status.At that time there was no figure printing ..Most people used to hide/destroy thier passports.US govt could not deport back as Indain Govt would not take thoes people stating that they don't belong to India  ....the people ,with the help of the lawyers used get GC easiy with the loop holes..later USCIS plugged these ad many loopholes by introducing fingure printing while issueing visas and also verifying them at PoE

BTW ,USCIS is planning to collect upto $5000 for GC fee and also back taxes .US govt plan to give work permits for two years for documented and not GCs directly
