After Consensual Sex, Woman can't cry rape: HC

In a landmark judgement a sessions court in Mumbai acquitted a man recently from charges of rape under the pretext of marriage. Court arrived at the decision after hearing the case and taking into consideration of the complainant's matured age (36 yrs) and also her marital status.

Shaida Razvi in her detailed judgement spread over 6 pages said the married lady who is matured with two children will have sexual relations with the accused at various times and this done with her own consent, ingredients of rape according to section 375 of IPC are not attracted.

Woman herself admitted to filing of case to a misunderstanding and later turned hostile in court and during the trial didnot want to proceed against the accused. Woman filed the case on March 30,2013 at Goregaon police station.

She in her complaint alleged that after staying alone with her daughter after separation and son with her ex husband, the accused invited her to his house on Nov 9,2011 at 10 PM asking her to marry him and have sexual relationship. She complained that when she told him she would think over it, he locked her and forced himself on her.

He later promised to marry her and later took her to a lodge and tied mangalsutra to her and from then on had sex on several occasions at various places till Feb 2013. She filed complaint as he officially did not marry her. Even the accused did not plead guilty.
