Crypto Posted January 3, 2015 Report Posted January 3, 2015 You can be even founder of a company on H1-B Simple logic..when you can be a share holder (liek a investor/partner) of any copany on H1-B ,(when you buy shares in any company) ...why not a owner ? Youcan not be on pay roll of yoru company ,but can take profits/earnings and report as 'other income' while you file taxes

I look legal opinion from a CPA before I formed by corp and Company formation has nothing to do with visa status ! Even a non-US resident can form a copany But H1-B employment rules may not allow to work your own company... unless you transfer it to your company. and IRS don't bother about how you earn money or whats your visa status..they just want taxes on your income /profits
