netflixmovies Posted January 30, 2015 Report Posted January 30, 2015 worked with Employer A until NOV 14, 2014. This H1 & I94 is valid until APR,2016 . This is still in Approved state. Not Revoked. Got H1 transferred to Employer B and worked for it from Nov 17,2014 to DEC 15, 2014. This H1 got approved until NOV, 2017. Revoke notice was sent to USCIS today JAN 29, 2015. In DEC, 2014 I got 2 offers from Employer C and Employer D. Employer C filed H1 transfer and it went to RFE on DEC 20, 2014. RFE not yet responded. I didn't join this Employer. Employer D also filed H1 transfer and it also went to RFE stage. But I joined Employer D with Receipt and working with it till date. Employer D responded to RFE but it got denied today - JAN 29, 2015. Now what are my options to stay in USA ? Can I switch to Employer C and have them respond to RFE ? Can I go back to Employer A as it is still in Approved state ?
jsk423 Posted January 30, 2015 Report Posted January 30, 2015 If employer your employer C responds to your rfe and if it is approved then yes If employer A has not revoked your H1 then you can always go back to him any time.
