thedarkknight Posted February 24, 2015 Report Posted February 24, 2015 After some research on the Land Acquisition Ordinance, here is my take on it. In 2013, Congress passed a much needed Act, presenting it as a pro-farmer act. But since Congress had realized that they would not come to power in the next term, they cleverly put kinks in the act which actually turned it into a deadlock so that the next Govt could struggle over it. It actually became anti-industry & anti-farmer. The 2013 Act was actually opposed by almost all State Govts. Even the Congress Govt in Maharashtra said it was not acceptable. All infrastructure & even defence projects were stalled throughout the nation. Even the great Congress sympathizer Amartya Sen said that the act needs refinement without which it can stall development. Even Saxena, a member of Sonia Gandhi's pet NAC team had hinted that the Act was anti-farmer & anti-industry, hence a lose-lose situation. The icing on the cake: President of India, Pranab Mukherjee today said that the Modi govt has done necessary refinements for the Act to make it better!! What was unacceptable in the 2013 Act? -It says that assessment had to be done to find out who apart from the land owners would be affected, and take them also into consideration. Instead, a simpler way would have been to compensate the land owner and those who are indirectly affected by it can fight with the land owner to get their share. It is like this: Suppose you are working for an IT company and the company wants to fire you now because there is no work in the company. You have a family, servants, drivers etc. They all depend on you. The most logical thing would be to compensate you with 6 month pay and fire you. But what Sonia Gandhi wanted was that the company had to find out who all will be affected and compensate all of them proportionately. i.e Compensate you with 3 months pay, your family members with 2 months pay, your servant with 15 day pay, your driver with 15 days pay and so on. In such a situation, it is a deadlock. The company will neither fire you and compensate, nor will they pay you salary because there is no work in the company anymore. -It says that if the acquired land is unused 5 years, then it must be returned to its owner. This is just insane. Govt projects take long time, not just to complete but even to get clearance. For example, if some land is acquired for building nuclear power plant and some krantikaris protest against it for few years, then according to the act, the land must be returned after 5 years because it is unused. -There are 13 other Land Acts through which land can be acquired without fair compensation, and this 2013 Act by Congress exercised no control over those acts. It was high time a single act was implemented which could cover all of them and provide fair compensation in all cases. It is issues like these which have been refined with the land ordinance last month. It does not punish the farmer in any way because the compensation still remains the same. It compensates the land owner and it is his headache to distribute it among people who are affected
