wololo Posted March 16, 2015 Report Posted March 16, 2015 I-140 apply chesaka RFE padi and if it gets rejected, then you need to restart with Perm again cuz validity is only 6 months from the date of Perm approval (provided you aren't in your 6th year of H1B). Final year of H1 and all aithe, then it is a whole different ball game altogether

Incase re-appeal lo kuda (regardless of 180 days) if it doesn't get approved, then back home velladame inka

I-140 reject aithe and if you still have some un-used time left on your 6 yr H1, then you can stay in the country and start with the re-appeal process If you've used up all your 6 yr timeframe plus any recapture time, then there is no other way, but to leave the country Re-appeal should be started immediately after rejection. No time should be wasted. Decision ki fixed timeframe emi undadu. Anytime you can get the approval or rejection. Max 180 days lo cheppali ani rule edo undi
