Wtf Law Man.. Woman Who Cut Baby Out Of Mother Not Charged With Murder

Authorities say the baby that was cut-out of her mother’s womb during an assault was not alive once out of her mother, freeing attacker Dynel Lane of murder charges.

 

The Boulder County Coroner, Emma Hall, said that investigators found no trauma or injuries to the baby girl, once she was cut from her mother, who was eight months pregnant.

 

The mother of the fetus answered a craigslist ad selling baby clothes when she was ambushed and stabbed.  The mother called 9-1-1, which police say saved her life, but it was too late for the baby.

 

The coroner’s findings support the district attorney’s decision not to file murder charges against Lane for the grisly attack.  In Colorado, the law states a person can only be charged with murdering a baby as long as the baby has survived outside of its mother.

The cases raises the debate of whether or not a fetus can be legally considered a human being.
