USCIS Reaches FY 2016 H-1B Cap
Release Date: April 07, 2015

WASHINGTON – U.S. Citizenship and Immigration Services (USCIS) has reached the congressionally mandated H-1B cap for fiscal year (FY) 2016. USCIS has also received more than the limit of 20,000 H-1B petitions filed under the U.S. advanced degree exemption.

USCIS will use a computer-generated process, also known as the lottery, to randomly select the petitions needed to meet the caps of 65,000 visas for the general category and 20,000 for the advanced degree exemption.

USCIS will first randomly select petitions for the advanced degree exemption. All unselected advanced degree petitions will become part of the random selection process for the 65,000 general limit. The agency will reject and return filing fees for all unselected cap-subject petitions that are not duplicate filings.

Before running the lottery, USCIS will complete initial intake for all filings received during the filing period, which ended April 7. Due to the high number of petitions, USCIS is not yet able to announce the date it will conduct the random selection process.

USCIS will continue to accept and process petitions that are otherwise exempt from the cap. Petitions filed on behalf of current H-1B workers who have been counted previously against the cap, and who still retain their cap number, will also not be counted toward the congressionally mandated FY 2016 H-1B cap. USCIS will continue to accept and process petitions filed to:

  • Extend the amount of time a current H-1B worker may remain in the United States;
  • Change the terms of employment for current H-1B workers;
  • Allow current H-1B workers to change employers; and
  • Allow current H-1B workers to work concurrently in a second H-1B position. U.S. businesses use the H-1B program to employ foreign workers in occupations that require highly specialized knowledge in fields such as science, engineering and computer programming.

  • It also announces that due to the high number of petitions, USCIS is not yet able to announce the date it will conduct the random selection process. In the past, they start running computer random selection process in next date of cap reach. Please stay tuned.

04/08/2015: FY 2016 H-1B Cap Reached for Both Regular Cap "and" U.S. Master Cap Yesterday

  • The exact number of petitions which the USCIS had received have yet to be released, but its cap count report indicates that they received more than 65,000 petitions for the regular cap cases and more than 20,000 special cap for U.S. Master degree cap cases at the end of the day yesterday. The USCIS will now first run computer random selection process to select the U.S. Master Cap winners and until it is completed, the USCIS will not be able to run the computer random selection process for regular cap cases. Once the U.S. Master Cap cases are selected and completed, the USCIS will then start running the regular cap computer random selection process including those U.S. Master Cap cases that had failed to be selected in the U.S. Master Cap selection process. Therefore, some of the U.S. Master Cap filers who failed to be selected in the initial U.S. Master Cap random selection process will have to go through the pains which all the regular cap filers will have to go through to lean for their chances for an extended period of time. HOWEVER, THERE IS A SAVIOUR FROM THESE INITIAL PAINS! Employers or their lawyers should check with their bank account on line or in person to find out whether their filing fee checks have been cleared and paid. Clearance of filing fee checks is an indication that their cases have been selected and they are lucky ones. Employers or their lawyers should have recorded the check numbers for their filing fees! For the cap count update, readers may visit from time to time the USCIS H-1B cap site.
  • Readers should keep in mind that the USCIS usually selects more than the annual cap numbers, considering the fact that there will be a number of cases which will be rejected or denied or withdrawn or revoked after being selected. Since the cases which are rejected or denied or withdrawn or revoked after being selected do not take out the cap numbers from the annual cap pool, the USCIS will have to use these numbers not to waste these annual cap numbers. Historically, these numbers have been recorded from 10% to 15%. Thus these reserved cases in the pool will eventually be saved before the end of the season. VOILA!
