karna11 Posted April 21, 2015 Report Posted April 21, 2015 04/21/2015: Approaching Time for H-4 EAD Application and Forthcoming USCIS Clarification for Various Unresolved Questions and Issues May 26, 2015 is the first date when the USCIS is scheduled to accept the I-765 EAD application from the qualified H-4 spouses. There are a number of questions which have yet to be answered for these H-4 nonimmigrants. The record of the AILA-USCIS HQ liaison meeting of 04/16/2015 reflects that the USCIS will release the frequently asked questions and answers soon. Additionally, at the end of the last USCIS teleconference on H-4 EAD, the panel indicated that they would schedule a follow-up teleconfeence when it approaches the start date of the H-4 EAD filing. Please stay tuned for these two upcoming additional sources of information for all the unanswered questions surrounding the H-4 EAD filing.

karna11 Posted April 23, 2015 Report Posted April 23, 2015 04/23/2015: Growing Problem of USCIS Delays in EAD Processing Reportedly, the USCIS has been experiencing delays in processing of EADs because of the shortage of resources and those who work on EAD are suffering from this delay. According to the USCIS Headquarter and AILA Liaison Meeting of 04/16/2015, they are working hard to resolve this issue and pending the resolution, applicants are encouraged to seek service request after 75 days of filing. However, readers report that they have a problem of getting relief through such service requests. In the past, the USCIS issued "Interim EAD" valid for 180 days if it passes 90 days, but the USCIS confirms that they no longer issue interim EADs. We urge the USCIS to reinstate the interim EADs to resolve the current problem. In the meantime, those applying for EAD should make it sure that they file the EAD applications 120 days before their current EAD expires.
karna11 Posted April 25, 2015 Report Posted April 25, 2015 04/24/2015: Alert: Group of American High Tech Workers Filed a Lawsuit in Federal District Court in DC to Declare H-4 EAD Rule Invalid and Seek Injunctive Relief This group filed a lawsuit yesterday, 04/23/2015, before the federal district court in District of Columbia seeking declaration and injunctive relief against the H-4 EAD rule. They claim the DHS/USCIS does not statutory authority to enact such rule and asks the court to declare the H-4 EAD rule is invalid. They also ask the court to issue a permanent injunction to prohibit implementation of this regulation. They also filed a motion for preliminary injunction to stop implementation of this rule. Interesting! See Save Jobs USA v. DHS, Civil Action No. 1:15-cv-615, United States District for District of Columbia, April 23, 2015.
