As we reported earlier, the plan of the U.S. Department of State to reform immigrant visa allocation reform has remained behind the closet. However, one report indicates that the State Department and USCIS have been reviewing their legal authority to recapture unused immigrant visas without legislation and another source indicates that they are currently leaning towards the conclusion that they do have the authority to do that without legislation. This website has been advocating this line of reform administratively for years and we welcome such move. Recapture of up to 250,000 unusued visas will very much wipe out the existing employment-based immigrant visa backlogs, even though it will not solve another future regression of employment-based immigration visas in the future after exhaustion of the recaptured immigrant visas.
