04/24/2015: Alert: Group of American High Tech Workers Filed a Lawsuit in Federal District Court in DC to Declare H-4 EAD Rule Invalid and Seek Injunctive Relief

• This group filed a lawsuit yesterday, 04/23/2015, before the federal district court in District of Columbia seeking declaration and injunctive relief against the H-4 EAD rule. They claim the DHS/USCIS does not statutory authority to enact such rule and asks the court to declare the H-4 EAD rule is invalid. They also ask the court to issue a permanent injunction to prohibit implementation of this regulation. They also filed a motion for preliminary injunction to stop implementation of this rule. The chance for this motion and lawsuit is dubious, but H-4 EAD stakeholders should be aware of this development involving anti-foreign worker forces activities.
