Recapture Of Unused Green Cards

Last Friday, Immigration Voice, the organization that has zealously represented highly skilled immigrants for several years, posted an interesting announcement indicating that on Monday, May 4th, a major announcement would be coming from the Administration that should not be missed. A lot of people got their hopes up over the weekend as speculation circulated regarding “pre-registration”, the Visa Bulletin being made current, recapture of unused green cards and more.

When nothing happened on Monday, many questioned whether IV knew what they were talking about. Today the group gave more information on what they had learned and, in fact, it’s consistent with another source of mine.

The White House has been working on the visa modernization plan that was mentioned in the President’s November remarks. The document is not actually going to change anything right away, but it will get in to the specifics of what actions the Administration plans to take. After the plan is released, we’ll begin to see the ideas implemented via guidance memoranda and new regulations. IV is now reporting that the plan, originally set for release on Monday, will now be released in a few weeks. I’m expecting to see the “pre-registration” concept in that document based on a recent statement by Ur Jaddou, the USCIS chief counsel, at an AILA conference in DC. But what else will be on the list is not yet clear.

Government doesn't give EAD or GC easily whatever they will give it would be another biscuit to bonded labour making the process go slow so they can retain us to work for another 10 yrs easily in hope of GC

they may not give GC but there may be (again may be) an announcement on broken heech to pachaa card process.

Which I think could be giving employers portability for 140 approved applicants nothing more than that.

Why would they simply throw away the money that they are getting as part administrative process for heech1 ... so definitely no to recapture of un-used paacha cards!!

Changing employers for applicants who have 140 approved is no less than risking PD, so they want to change process so we need not start for scratch

05/06/2015: All Eyes Are on June 2015 Visa Bulletin From the Perspectives of Visa Bulletin Reform

  • Visa Bulletin affects three broad groups of immigrants. One is the group who has filed I-485 application and waiting for the I-485 approval when visa number becomes current for her or him. The second group is those who have approved I-140 petition and eager to go into the mainstream labor market, more or less free from hostage level of their lives pending the visa number current. The third group is those who are still in labor certification process or pending I-140 stage. The third group has no immediate interest and stake for the June Visa Bulletin, but the first and second group are.
  • Nowadays, the second group got into the center of the employment-based immigrant community's focus and the impact of the Visa Bulletin reform is extremely important. There are two ways to achieve I-140 EAD. One is opening up visa cut-off date such that those with approved I-140 can file I-485 along with EAD just as the precedent in 2007. For this one, we do not need a rule-making process. Another way to get to it is to expand the existing AC 21 law interpretation to include the approved I-140. for portability and EAD eligibility. This rule-making process is already in the agency's plan and scheduled to be released as early as October 2015. However, the first approach cannot be brushed aside either. Visa Office can consider three tools: (1) Use of unused immigrant visa numbers from other immigration programs and other countries. Currently, ROW consumption of the EB visa numbers are so low and some of the numbers may go unused and wasted unless this option is considered. (2) Recapture of past unused immigrant visa numbers. (3) Open up FY 2015 EB immigrant visa numbers to Current or allocate the balance of FY 2015 quota numbers before the 4th Quarter of the year, which will end up exhaustion of EB visa numbers earlier than the end of the fiscal year (09/30/2015) and the number may become Unavailable for a couple of months. As for the (3) approach, Oppenheim already indicated that India EB-2 numbers may slow down or move backward during the last two month, August and September, after continuing move-forward (?) of the cut-off dates in June and July. Oppenheim has a power to decide how to allocate the visa numbers during a year but for the FAM. FAM is not a rule and just like a policy manual or memorandum for DOS. This can be changed without rule-making process. We want to see how these tools may be used by the Visa Bureau in June 2015 Visa Bulletin as part of implementation of the President Obama's promise to reform Visa Bulletin management process.

You are very eager to get GC/EAD, you might be having your own reason and I wish you the very best, I'm also as enthusiastic as you are but never want that to be constant deliberation back of my mind.

 

Bottom line what he is saying simple way to address current issues with h1-to-gc path is to make dates current which does not require any law very simple - but by doing this no one gets advantage, no votes earned so highly unlikely to see this happen

Another long route is to make rule pass for 140-EAD/portability which will be 2-3yrs like you said.

 

All said as per the current predictions dates might move another 6-18 months in 2015 and stop. So hope for the best stop worrying about it(if you are worried)
