texas Posted May 8, 2015 Report Posted May 8, 2015 Is it risky to transfer ech-1 post 6-year regular period. Because, if previous approved 140 is revoked by the prev employer, before the new employer applies for GC, we wont be aable to renew/ extend ech1 based on approved-140 basis (coz, the approved onne already revoked)?????? Calling ech1 veterans and experts... Technically, its not at all risky. File the H1B transfer and join the new employer after the transfer gets approved. Once you join the new employer, the new employer will have to start the GC process right from scratch again. However if you have a copy of your previous I-140 approval notice, then you can port the priority date to file form I-485 It would not be a transfer with an extension. It would be a transfer with a request for consular processing.

texas Posted May 8, 2015 Report Posted May 8, 2015 No...not my case....I am asking about a scenario.... Ok..why will revoke your i140 when you are on this payroll? He will revoke once you make a transfer, that should not be a problem once you transferred to other employer If we talk about scenarios there will be lot of options left which will be completely different from real life...so chill and enjoy the weekend Bhayya
