former Posted May 12, 2015 Report Posted May 12, 2015 I found on my emails. Unfortunately, I need to advise that I need to hold your Green Card initiation until you transition to H1B status. The reason being is that F-1 student visas do not allow dual intent (i.e., the intent to come to the US for a given temporary purpose – here, going to school—plus the intent to permanently remain here, as evidenced by being sponsored for GC status).

So H1B vachhi naka apply cheyali annadu. Nee question naku answer teliyadu. Better contact Lawyer opt lo employement nadustunte already you can go head and apply.. my all batch mates did and got i140 approved within time....

Desi consultancy lu ani opt lo ne chestahyi ga to be honest random audits padhunnayi these days.. and getting labour approved is not easy as before.. audit padinappudu you have to show.. the paper advertisements and all the background paper work of your hiring and interview results etc... genuinely... considering all this, gc ead is 6 month process... before they actually apply..
texas Posted May 12, 2015 Report Posted May 12, 2015 A GC is independent of H1 or F1. But, an I-140 does not give you any immigration rights. When your OPT expires, you would have to leave the country or get another stats, e.g., H1 or Masters Again. And it can be years until the PD becomes current. The PD is ALWAYS the date the first application in a case is received by the authorities. Also, when an I-140 is filed, you can not travel abroad and come back on an F1, because the F1 doesn't allow immigration intent, but the I-140 shows immigration intent. Simple no why fighting bros
