It Company Employees From Jersey City Charged In Work Visa Scheme

Two Jersey City women were arrested today and charged with fraudulently using a visa program to cut down skilled labor costs for a pair of information technology companies, U.S. Attorney Paul J. Fishman's office announced.

Hiral Patel, 32, and Shikha Mohta, 31, were each charged with one count of conspiracy to bring in and harbor aliens and to obstruct justice. They are scheduled to make their first court appearances on the charges today in Newark federal court at 2 p.m. before U.S. Magistrate Judge Mark Falk. 

Patel, the human resources manager for SCM Data Inc. and MMC Systems Inc. -- two companies that provide software and technology solutions to outside businesses -- and Mohta, the head of finance for SCM Data, recruited foreign workers with purported IT expertise who sought work in the United States, according to the criminal 13-page complaint. 

SCM Data, located in Jersey City, and the Virginia-based MMC Systems, offers consultants to clients in need of IT support and sponsored the foreign workers' H-1B visas. The visa program allows American business to temporarily employ foreign workers with specialized or technical expertise, but requires those businesses to pay the consultant full-time wages, even if there are periods when the employee is not working full-time, the complaint states. 

But when submitting the visa paperwork to the U.S. Department of Homeland Security, Patel, Mohta and other conspirators falsely represented that the foreign workers had full-time positions and were paid an annual salary, according to the complaint. 

Instead, Patel, Mohta and others paid the foreign workers only when they were placed at a third-party client who entered into an IT service contract with SCM Data or MMC Systems, according to the complaint. 

In some instances, Patel, Mohta and others generated false payroll records to create the appearance that the foreign workers were paid full-time wages. On multiple occasions the conspirators required workers to pay SCM Data or MMC Systems their gross wages in cash. In exchange, the companies deducted taxes and fees and issued payroll checks to the foreign workers in a smaller amount, the document states. 

The foreign workers were then encouraged to submit the bogus payroll checks to the DHS as proof that they were engaged in full-time work despite the fact that they were not working for SCM Data and MMC Systems, according to the complaint. 

The conspiracy charge carries a maximum penalty of five years in prison and a $250,000 fine.
