Man Studies Law To Fight Case Against Wife's False Rape Charges

An insurance agent, who was accused of abducting and raping his wife, studied law during his 9 year legal battle and filed a Rs 50 lakh defamation suit against the accuser after being acquitted by two courts.

Pankaj Chavda, an insurance agent by profession, and his 19-year-old neighbour registered their marriage in the registrar’s office in 2006 and eloped to Udaipur and Jaipur for two weeks. Upon returning, Chavda’s wife lodged an FIR claiming Chavda and his friend, Lokesh Sharma, who was incidentally her tuition teacher, had raped and blackmailed her and forced her to marry him. Based on this FIR, Chavda and Sharma were arrested and sent to custody.

However, in 2013, the court observed that the claims made by the accuser were false and acquitted the two accused. On approaching the Gujarat HC, it too observed Chavda innocent of the charges.

Following the judgements, Chavda, now a practising advocate, slapped a Rs 50 lakh defamation suit against his wife for implicating him and his friend in a false rape case.

“Rape causes greatest distress and humiliation to the victim, but at the same time, a false allegation of rape can cause equal distress, humiliation and damage to the accused person as well,” said Judge U T Desai sympathizing with the youths.

In a similar case in which a Delhi businessman was acquitted of rape charges in January, a Delhi court strongly condemned the misuse of rape laws. Not only do false rape cases immensely humiliate, traumatize and ostracise the accused, but also they tend to trivialise the offence of rape. “Time has come when the courts should deal firmly with the women filing false complaints of rape. These women, who turn out to be tormentors and not the victims, should be punished under the appropriate provisions of law,” it said.

I met with one Rtd United Indian Insurance Employee in Hyd couple years back. He went through his own case (498A and SC/ST) against his 1st wife for 22years and no lawyer were accepting his case and case was keep on prolonging even after paying 2 crores as settlement. After his rtd he studied Law books towards his own case for 1 year and owned in the next year on his own to get his full pension. Really hats-off to get out of mental tensions cases.
