Etihad Airways Says U.S. Carriers Got Government, Court-Sanctioned Benefits

Etihad Airways issued a report Friday saying the three largest U.S. airlines have received $70 billion in government and court-sanctioned benefits as the heads of U.S. carriers spoke in Washington on Friday to press their claims that Etihad and two fellow Persian Gulf carriers have benefited from tens of billions of dollars of unfair state subsidies.

Etihad was reacting to claims made early this year by the Big Three U.S. carriers that it allegedly has received more than $17 billion in state subsidies from its owner, the Abu Dhabi government, since 2004. Etihad has denied those claims, saying it has received equity and shareholder loans from its state owner.

The U.S. airlines also say Qatar Airways of Doha has scooped up more than $16 billion in subsidies in the same period from its government owner, while Dubai’s Emirates Airline has benefited from at least $5 billion. Qatar and Emirates also have issued heated denials.

Etihad in early March engaged Risk Advisory Group, a London-based investigation and intelligence firm, to review financial and government benefits provided to American Airlines Group Inc., United Continental Holdings Inc. and Delta Air Lines Inc. In an 18-page report, the firm alleged that the three U.S. airlines benefited from about $35 billion in bankruptcy-court debt relief and related recurring cost savings. They also received $29 billion in pension-fund bailouts while they were being restructured, the report said.

In addition, the Etihad-sponsored report said, the three U.S. airlines got about $5.6 billion in fuel subsidies and nearly $1 billion in preferential financing from a range of state aid, incentive packages and financing, and government bond proceeds to develop airline facilities. “There is no evidence whatsoever of any harm caused by Etihad Airways to any of the three big U.S. airlines,” Etihad’s general counsel, Jim Callaghan, said in a statement.

The bankruptcy savings, permitted by chapter 11 of the U.S. bankruptcy code, grant debtors the right to receive protection from creditors as they reorganize and restructure their debt. Most of the savings in these cases come from creditors, who make concessions and sometimes receive just cents on the dollar of what they are owed when a company emerges from court protection. While creditors can be holders of public debt, members of unions and firms that do business with the airlines, they are generally not the federal government.

United and Delta moved to terminate some of their underfunded pension plans in chapter 11. The Pension Benefit Guaranty Corp., an agency created by Congress that receives funding through insurance premiums paid by private employers, took those plans over. The report said that United’s pension terminations foisted a $13.6 billion liability on the PBGC and incurred $3.2 billion in harm to the plan participants. Delta’s single termination brought a nearly $3.5 billion liability to the agency, the report said.

The report also said American Airlines created a $6 billion liability for the PBGC and a $2 billion cost to plan participants. American didn’t terminate any of its plans but instead froze them. That means employees can keep the benefits accrued to that point and move to a new form of retirement benefits in the future.
