I am currently working for YYY company from past 6 months as a Full timer and got laid off and my last day of work would be May 31st. YYY will revoke my H1b on May 31st. Is it really possible that they can revoke exactly on May31st? They said, They ll inform USCIS. Does informing is different from revoking? 2. My Ex-employer XXX is ready to file a H1b transfer with In-House project but chances are less to get approved with In-house project.. Isn't it? Meanwhile I am looking for contracting jobs with my current TITLE. 3.I got a Full-time offer from a decent american company(ZZZ) but they are slow processing. May be able to file LCA and file H1b by June 15th. My choices: 1. Go with XXX and file In-house H1b Transfer and wait for contracting job? When I get contracting job, Should I just make H1B and LCA amendment with new title and responsibilities? Or 2.Take Full time with ZZZ ? - Will I be out of status from June01 - June15 (until zzz files H1b transfer).? - If I am out of status for 15days. Does it affect my h1b transfer with ZZZ or future employment or GC? - Should I leave the country and go for stamping b/w June01-June15 ? I already have stamping until 2016? - What If YYY revokes my H1b after June 15 and By the time, ZZZ sends H1b files for transfer? Do I still have any issues? Thanks in advance.

At the most...i94 raadu..if u have valid visa..u can re-enter US and get i94 updated/renewed. - Should I leave the country and go for stamping b/w June01-June15 ? I already have stamping until 2016? Check with current employer and ask for some negotiation on dates for revoke eg: until June 15
texas Posted May 18, 2015 Report Posted May 18, 2015 Best bet is to go back to your old employer XXX and file H1 transfer right away as in-house as regular processing, they will take time for your H1B process. Meanwhile find a job as contracting and incase of any query you can answer with your client letter(if required) and YES there are changes that they might cancel/revoke your H1 right on 31st, HR might have already send the paperwork to USCIS by now. Second option which is little tricky but possible...Transfer to XXX as regular and with the receipt number you can transfer to ZZZ from XXX(do this in premium), I mean transfer from XXX to ZZZ when your H1 is under process to XXX and believe me... you can do this and it has been done many times, if needed please google. SO once your second H1 is under premium, they will process your first H1 transfer ASAP. This sounds fishy but its possible. Good Luck Bro :) 1

While there is no law which dictates the amount of time an H1B worker can remain in the country after a layoff it is necessary to seek alternate employment/ change of visa status as soon as possible because once the employment ends, you immediately lose your status. As of right now, there is no grace period and the 10-day rule which so many people reference actually only applies to the period before and after the petition ends. It’s best to meet with an H1B attorney to determine what change of status would be most feasible for your situation.

You should get the receipt number for your H1B transfer before 31sy may

And after approval u can take the full time offer and move to that client.. Employer ki paisal evvau.. And contracting lo transfer tough adi depends on case to case.. ATB
